By accessing our website, joining our loyalty program, placing an order, or utilizing our services, you agree to be bound by these Terms. If you do not agree to all terms and conditions, do not use our website or services.
1. Mandatory Age Requirement (Strictly 21+)
You must be at least twenty-one (21) years of age to access, browse, or make purchases through our website or at any of our retail locations.
- Age Representation: By accessing this site, you certify and warrant under penalty of perjury that you are at least 21 years old.
- Mandatory ID Verification: In compliance with Texas law and Texas Alcoholic Beverage Commission (TABC) regulations, valid, government-issued photo identification (such as a current driver’s license, state ID, military ID, or passport) proving you are 21 years of age or older is strictly required for:
- All in-store purchases of beer, wine, spirits, and hemp/THC products.
- In-store order pickups.
- Any deliveries fulfilled by third-party delivery services or Texas Liquor staff.
- Underage Prohibition: We reserve the right to refuse service, cancel orders, deny entry, or terminate accounts immediately if we suspect any individual is under 21 years of age or attempting to purchase alcohol or hemp on behalf of a minor.
2. Alcoholic Beverages & Regulated Products
- Compliance with Texas Law: All alcohol transactions, retail sales, tastings, and deliveries are conducted in accordance with the Texas Alcoholic Beverage Code and administrative rules enforced by the TABC.
- Hemp & THC Products: All consumable hemp and hemp-derived cannabinoid products sold by Texas Liquor are intended exclusively for adults aged 21 and older and comply with federal and Texas state statutes. You are responsible for ensuring your possession and use conform to all local rules and regulations.
- Right to Refuse Service: Texas Liquor personnel, delivery drivers, and contracted staff reserve the absolute right to refuse the sale or delivery of alcohol or hemp products to anyone who appears intoxicated, fails to provide valid government identification, or is suspected of purchasing for minors.
3. Texas Liquor Loyalty Program
- Eligibility: Membership in the Texas Liquor Loyalty Program is complimentary and strictly open to legal residents aged 21 and older.
- Earning & Redeeming Points: Members earn points on qualifying retail purchases. Points may be redeemed for discounts (such as 10% off purchases at 250-point intervals) and eligibility for allocated bottle releases. Points carry no cash value, are non-transferable, cannot be redeemed for cash, and may not be combined with prohibited promotions under TABC guidelines.
- Allocated Bottles & Limited Releases: Loyalty points provide opportunities or eligibility to purchase allocated, rare, or private barrel selections. Program membership does not guarantee inventory or bottle availability.
- Modification & Termination: We reserve the right to audit, amend, suspend, or terminate loyalty program rules, point conversion rates, or individual accounts without prior notice if fraudulent activity or abuse is detected.
4. Event Support, Bartending & Custom Orders
- Event Bartending & Catering: All event bartending, drink planning, and staffing inquiries are subject to separate formal agreements, scheduling availability, and applicable local permitting requirements. Clients must ensure that no individuals under the age of 21 are served alcoholic beverages during events.
- Special Orders & Kegs: Orders for craft, domestic, or import kegs (1/6, 1/4, or 1/2 barrels) and specialty bottles require advance notice (typically 1–2 business days for domestic/import and 5–7 business days for craft) and may be subject to non-refundable deposits.
- Private Tastings & Social Clubs: Participation in in-store tastings or community clubs (e.g., Old Victoria Bourbon Society, The Agave Collective) requires valid 21+ identification prior to sampling.
5. Delivery Services
- Third-Party Platforms: Deliveries placed via third-party partners (such as DoorDash, Favor, or ASAP Food Delivery) are fulfilled subject to the delivery partner’s respective terms and fees.
- Recipient Verification: Alcohol deliveries will not be left unattended, on doorsteps, or delivered to any recipient who fails to present valid 21+ photo ID matching the order details. If recipient identification cannot be verified or intoxication is observed, the delivery will be canceled, and restocking or delivery fees may apply.
6. Pricing, Availability & Product Descriptions
- While we endeavor to keep all product descriptions, inventory listings, and pricing up to date, inadvertent typographical errors or inventory discrepancies may occur.
- We reserve the right to correct pricing errors, alter product selections, adjust bottle allocation limits, or cancel orders arising from erroneous website listings without liability. Product availability varies across our retail locations (Houston Hwy, John Stockbauer, US-87 Nursery, and Port O’Connor).
7. Intellectual Property & Website Use
All content on this website—including text, graphics, logos, images, private barrel labels, design elements, and software—is the property of Texas Liquor or its licensors and is protected by United States copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, scrape, or exploit any site content without prior written consent from Texas Liquor.
8. Limitation of Liability & Disclaimer of Warranties
- As-Is Basis: Our website and services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.
- Limitation of Liability: To the maximum extent permitted by applicable law, Texas Liquor, its owners, employees, contractors, and agents shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from your use of, or inability to use, this website, products purchased, or event services provided.
